Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Instant Prop Fund website and services (the "Service") operated by Instant Prop Fund ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Account Creation

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

Account Security

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trade mark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

Instant Simulated Funded Accounts

Instant Prop Fund provides proprietary trading simulated funded accounts services. By participating in our simulated trading program, you agree to:

• Trading Rules - Adhere strictly to all trading rules including maximum daily loss, maximum overall drawdown, and minimum trading days.
• Trading Restrictions - Not engage in prohibited trading strategies including but not limited to tick scalping, hedge arbitrage, reverse arbitrage, or using server latency advantages.
• Fair Trading - Conduct all trading activities in good faith and in accordance with accepted market practices.
• Account Monitoring - Allow us to monitor your trading activity for compliance with our rules and regulations.
• Continued compliance with all trading rules and regulations
• Profit split agreements as specified in your account terms
• Payout policies and minimum payout thresholds
• Account scaling opportunities based on performance
• Risk management requirements and position sizing limits

Account Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. This includes but is not limited to:

• Violation of trading rules or prohibited strategies
• Provision of false or misleading information
• Attempted manipulation of the trading system
• Failure to comply with payout or verification requirements
• Engaging in fraudulent or illegal activities

Instant Simulated Funded Accounts Fees

All simulated funded accounts require an upfront fee which is non-refundable except as explicitly stated in our refund policy. The fee covers the cost of providing the instant simulated funded accounts platform, market data, and support services during your trading period.

Profit Sharing

For funded accounts, initially profit distribution is based on the profit split percentage agreed upon in your account terms. Typical starting profit splits are:

• Standard accounts: 75/25 split (trader/company)
• Turbo accounts: 75/25 split (trader/company)

Payout Schedule

Payouts are processed according to the following schedule:

• First payout: Available after 14 calendar days of funded trading
• Subsequent payouts: Weekly after new trade placed
• Minimum payout threshold: $100 or equivalent in other currencies
• Processing time: 1-5 business days depending on payment method

The Service and its original content, features and functionality are and will remain the exclusive property of Instant Prop Fund and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Instant Prop Fund. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on our Service without our prior written consent.

Trading Risks

Trading in financial markets involves substantial risk and is not suitable for every investor. You should carefully consider whether trading is appropriate for you in light of your experience, objectives, financial resources and other relevant circumstances. Key risks include:

• Market Risk - The value of investments can go down as well as up due to market conditions.
• Leverage Risk - Trading with leverage can amplify both profits and losses.
• Volatility Risk - Market volatility can result in rapid and substantial losses.
• Liquidity Risk - There may be times when it is difficult or impossible to liquidate a position.

No Investment Advice

Nothing contained in the Service constitutes investment advice, financial advice, trading advice, or any other sort of advice, and you should not treat any of the Service's content as such. Instant Prop Fund does not recommend that any financial instrument should be bought, sold, or held by you. We are not responsible for any losses or damages arising from your trading decisions.

In no event shall Instant Prop Fund, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use or alteration of your transmissions or content
• Trading losses incurred during trading on simulated funded accounts

The limitations of liability set forth above are fundamental elements of the basis of the bargain between Instant Prop Fund and you. The Service would not be provided without such limitations.

You agree not to engage in any of the following prohibited activities:

• Using the Service for any illegal purpose or in violation of any laws
• Attempting to interfere with, compromise or disrupt the Service
• Copying, selling, reselling, or exploiting any portion of the Service
• Using automated systems or software to extract data from the Service
• Impersonating any person or entity, or falsely stating or misrepresenting your affiliation
• Submitting false, inaccurate, or misleading information
• Engaging in any form of market manipulation or prohibited trading strategies
• Creating multiple accounts to circumvent simulated funded accounts or trading rules
• Sharing account credentials or allowing others to trade on your account

You agree to defend, indemnify and hold harmless Instant Prop Fund and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

These Terms shall be governed and construed in accordance with the laws of United Kingdom, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

It is your responsibility to check these Terms periodically for changes. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service and contact our support team.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service. Any failure on our part to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
